Acceptance of Terms

By using Hire by No Human Nearby (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.

Acceptable Use

You may not use the Service to:

• Submit illegal, harmful, or threatening content.
• Generate child sexual abuse material (CSAM) or non-consensual intimate imagery.
• Impersonate real individuals or create deepfakes of real people.
• Generate political disinformation, election interference material, or propaganda.
• Attempt prompt injection, jailbreaking, or adversarial attacks against our AI systems.
• Generate malware, phishing materials, or tools for cybercrime.
• Generate content that infringes on others' intellectual property.
• Submit content depicting or promoting violence, abuse, or exploitation.
• Use the Service for spam, phishing, or fraud.
• Reverse-engineer, scrape, or abuse the platform.

We reserve the right to refuse, block, or terminate service to anyone who violates these terms, at our sole discretion and without notice.

AI Output Disclaimer

Outputs are generated by artificial intelligence and may be inaccurate, incomplete, or contain “hallucinations” (plausible-sounding but factually incorrect statements). All outputs are provided AS-IS, with no warranty of any kind. We make no guarantees regarding:

• Accuracy, completeness, or correctness of outputs.
• Fitness for any particular purpose.
• Originality or non-infringement of AI-generated content.

You are solely responsible for reviewing and verifying the accuracy of any output before relying on it, publishing it, or using it for commercial purposes. AI-generated content should not be relied upon as professional, legal, medical, or financial advice.

User Responsibility

You are responsible for all content you submit to the Service and all content you receive from it. You assume full responsibility for how you use AI-generated outputs, including any consequences of publishing, distributing, or acting on them.

Indemnification

You agree to indemnify, defend, and hold harmless No Human Nearby, its owner, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from: your use of the Service; your violation of these terms; your use of any outputs generated by the Service; or any content you submit as input, including but not limited to claims of copyright infringement relating to uploaded materials.

Intellectual Property

We assign to you all right, title, and interest in and to the outputs generated by your inputs. However, under current US Copyright Office guidance, purely AI-generated content may not be eligible for copyright protection.

AI-generated outputs may not be original and may resemble existing works. We make no guarantees that outputs are free from third-party IP claims. You are responsible for determining the legal status of outputs in your jurisdiction and ensuring your use complies with applicable copyright and intellectual property laws.

Payments & Refunds

All payments are processed through Stripe. By purchasing a job, you agree to pay the listed price. AI-generated outputs are treated as consumed digital goods due to the immediate, compute-intensive nature of generation.

• Delivered work: All purchases are final and non-refundable once a job has been completed and delivered.
• Failed processing: If we fail to deliver your job due to a technical failure, contact us within 7 days for a full refund or credit.
• Disputes: Contact [email protected] to dispute a charge or report a quality issue.

Limitation of Liability

To the maximum extent permitted by law, No Human Nearby shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid for the specific job giving rise to the claim.

DMCA & Copyright Notices

We respect intellectual property rights. If you believe your copyrighted work has been infringed by content on our platform, please submit a DMCA takedown notice to [email protected] including:

• A description of the copyrighted work you claim has been infringed.
• The URL or description of where the infringing material is located.
• Your contact information (name, address, email, phone).
• A statement that you have a good-faith belief the use is not authorized by the copyright owner.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Service Modifications & Termination

We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We may suspend, limit, or terminate your access immediately, without notice or refund, if you violate these terms, our Acceptable Use Policy, or place an unreasonable burden on our infrastructure.

Governing Law

These Terms are governed by the laws of the State of California, United States. Any disputes shall be resolved in the courts of California.

Changes to These Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will update the “Last updated” date at the top of this page when changes are made.
